1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you (“you”, “customer”) and McCabe Fine Furnishings (“we”, “our”, “us”) regarding your use of our website and the purchase of our products.

By accessing or using our website and/or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

We reserve the right to update or modify these Terms at any time. Continued use of the website after changes are posted constitutes acceptance of those changes.

• Refuse orders where delivery is not feasible or practical
• Refuse orders outside of our delivery area or where delivery costs are unreasonable
• Cancel orders where products are no longer available or incorrectly listed

A contract is only formed once we confirm acceptance of your order.

4. Product Availability

All products are subject to availability.

We do not guarantee that items shown on our website will always be in stock. We reserve the right to withdraw, replace, or modify products without prior notice.

If a product becomes unavailable after an order is placed, we will offer a replacement or full refund.

5. Pricing and Payment

• All prices are shown in GBP (£) and include VAT unless otherwise stated
• We reserve the right to change prices at any time prior to order acceptance
• Full payment is required before dispatch unless otherwise agreed

We accept payment methods displayed at checkout (including card payments and other digital payment options).

6. Delivery

We currently deliver within Ireland.

Delivery outside Ireland may be considered on request but is not guaranteed and may require additional charges and arrangement before acceptance of the order.

We reserve the right to refuse delivery where:

• The delivery location is outside our service area
• Delivery costs are excessively high or impractical
• Safe access to the property is not possible
• Logistics prevent successful delivery

Delivery dates are estimates only and may be affected by supplier delays, transport issues, or circumstances outside our control.

Customers are responsible for ensuring safe and suitable access for delivery.

7. Risk and Ownership

Ownership of goods remains with McCabe Fine Furnishings until full payment has been received.

Risk in the goods passes to the customer upon delivery.

8. Cancellations

Orders may only be cancelled before dispatch or before goods are ordered from suppliers.

Custom, special-order, or made-to-order items cannot be cancelled once processing has begun.

We reserve the right to cancel any order if necessary, with a full refund issued where applicable.

9. Returns and Refunds

Returns are accepted in accordance with our Returns Policy. Certain items may be non-returnable, including:

• Special order items
• Made-to-order furniture
• Clearance or sale items
• Customised products

Items must be returned in original condition and packaging where applicable.

Returns, Access & Restocking Fees

If goods are delivered correctly but cannot be moved into the customer’s property due to access restrictions, incorrect measurements, or insufficient space, the customer will be responsible for all associated costs.

This includes (but is not limited to) failed delivery charges, redelivery fees, and handling costs. Where goods are returned to us for this reason, a 20% restocking fee will apply.

Items must be returned in their original, unused condition and packaging where applicable. Any additional transport or handling costs incurred will also be charged to the customer.

We strongly advise all customers to carefully measure all access points (including doorways, staircases, and lifts) prior to placing an order.

10. Customer Responsibility

Customers are responsible for:

• Ensuring correct measurements prior to ordering
• Ensuring adequate access for delivery
• Ensuring products are suitable for their intended use and location

We are not responsible for items that cannot fit through access points or into properties.

11. Limitation of Liability

To the fullest extent permitted by law, McCabe Fine Furnishings shall not be liable for:

• Indirect or consequential losses
• Loss of income or profits
• Delays beyond our control
• Third-party courier or supplier issues
• Installation costs or removal of goods

Our total liability shall not exceed the total value of the goods purchased.

12. Force Majeure

We are not responsible for delays or failure to perform obligations due to events outside our reasonable control, including:

• Supplier shortages
• Transport disruptions
• Weather conditions
• Industrial disputes
• System or network failures

13. Intellectual Property

All content on this website is owned by or licensed to McCabe Fine Furnishings.

You may not reproduce, copy, or distribute any material without written permission.

14. Privacy

Your use of this website is also governed by our Privacy Policy.

15. Governing Law

These Terms and Conditions are governed by the laws of Ireland.
